Higher Fine for Violation of Labor Standards Act
The Council of Labor Affairs, Executive Yuan, proposed to amend the Labor Standards Act and to raise the fine level for violation of the Labor Standards Act. According to the proposed amendments, the fine will be raised to three to five times higher than the current rate.
According to the statistics of the Council of Labor Affairs, the non-payments of severance pay and wages are the most frequently reported violations of the Labor Standards Act during the past year in Taiwan. The Council of Labor Affairs proposed to raise the maximum fine for non-payments of pay severance pay from NT$ 90,000 to NT$ 450,000. Similarly, the maximum fine for non-payments of wages and overtime pay will be raised from NT$ 60,000 to NT$ 200,000. The Council of Labor Affairs expects that the proposed amendments will constitute a stronger deterrence for employers. The proposed amendments also much welcomed by the unions.
