Legalize Unlawful Factories After 7-Year Training Period
Taiwan’s Legislative Yuan passed amendments to the Regulations for Management and Training for Factories on 4 May 2010, which provide that unregistered factories can legally operate after a 7-year training period if certain legal requirements are satisfied; further, if such unregistered low-pollution factories satisfy certain legal requirements, such factories can pay a fine within 2 years and apply for temporary factory post-registration.
The Industrial Development Bureau (IDB) will stipulate enforcement rules and relevant regulations within six months after promulgation of the amendments. With respect to what level of pollution qualifies as “low-pollution”, the IDB will discuss and determine the criteria with the Environmental Protection Administration, Council of Agriculture, Department of Health and related scholars and experts.
In addition, the amendments also include stipulations that factories must fulfill their responsibilities of safe management when manufacturing, processing or using dangerous items. If any material environmental pollution or serious industrial accident occurs and causes harm to other factories or people in its vicinity, the relevant government authority can order the factory to shut down and demand remedial measures.
