Judicial Scandals Call for Amendments to the Draft Judges Law

Due to recent scandals involving several Taiwanese judges, the public has called for amendments to the draft Judges Law so as to include a judge evaluation and disqualification system.

The judges disqualification system is one of the hottest issues being discussed in connection with the draft Judges Law. The disqualification system under discussion includes evaluation and disciplinary sanctions for judges. A committee, formed by lawyers, scholars, prosecutors and other representatives from the public, will be established to evaluate the performance of judges. The draft Judges Law will also establish an exclusive chamber to deal with disciplinary sanctions against judges.

Moreover, the draft Judges Law will revoke the hierarchy of judges. In the future, senior and junior judges will only have different scopes of work and different salaries, while no other hierarchical or dominant relationship of any kind will exist. The reform aims at helping judges to concentrate on properly performing their duties, rather than being distracted by striving for promotion. The draft Judges Law will also apply to prosecutors.
