Market Price Proposed as Calculation for Compensation in Land Expropriations

In view of the disputes arising out of the expropriation of agricultural lands in Tai-Pu, Miao-Li and lands near the Central Taiwan Science Park, the Department of Land Administration under the Ministry of the Interior has convened the 3rd forum on the Land Expropriation Act. The forum proposed that compensation for expropriated land be calculated subject to the market price, rather than by the announced current value of the land determined for the purpose of taxation. The proposal will be submitted for review to the Executive Yuan.

Scholars and experts have indicated that landowners’ compensation for land expropriation in accordance with the land’s market price has been paid in the United States, the United Kingdom and Japan. Taiwan will look to these countries to improve its own compensation system.

In the forum, the government authority in charge of land expropriation has agreed to convene at least two public hearings to improve communication with landowners.
