Violation of Environmental Protection Laws May Result in Mandatory Participation in Seminars

The Environmental Protection Administration recently passed the “Guidelines on the Exercise of Discretion”, which was drafted according to the Environmental Education Act. The Guidelines prescribe that when there is a violation of the environmental protection laws or ordinances that would result in a fine equivalent to or more than NT$ 5,000 or an order to stop work or business, the violator shall be forced to participate in a seminar on environmental protection for 1 to 8 hours. The Guidelines also contain the required time for such participation corresponding with the amounts of the fines. These Guidelines will be effective from 5 June 2011, which is also the effective date of the new Environmental Education Act.
