Amendment to Children and Youth Welfare Act Passed Preliminary Review at Legislative Yuan
The Social Welfare, Environmental and Hygiene Committee of the Legislative Yuan recently passed a preliminary review of a proposed amendment to the Children and Youth Welfare Act (“Amendment”), which renames the Act as the Children and Youth Welfare and Rights Protection Act.
The Amendment stipulates that any detailed descriptions and/or pictures in connection with violence, bloody scenes, pornography, obscenity or forced sexual intercourse as well as crimes or drug abuse committed by children or the youth are prohibited from being posted in a newspaper. A fine of NT$ 100,000 to NT$D 500,000 will be imposed for any violation of this regulation.
Further, the Amendment also stipulates that except for adoptions made by relatives, parents or guardians, the adopters and the adoptees can only be matched by Government-approved children and the youth welfare institutions that provide adoption services in order to evaluate and ensure the necessity and appropriateness of the intended adoptions. The courts may also order the adopting parents to take preparatory courses, to undergo mental health checks or take alcohol and drug tests before granting an adoption approval.
The Amendment is expected to provide children and the youth with better protection, welfare and care.
