Enterprises in the Food Industry shall Recall Expired Foods and propose Destruction Plan
In order to regulate enterprises in the food industry, the Department of Health (“DOH”) has considered issuing the Food Recall and Destruction Regulations (食品回收銷毀管理辦法) (“Draft Regulations”). Under the Draft Regulations proposed by DOH, an accountable enterprise shall provide a recall and destruction plan to execute the recall and destruction of expired foods. The plan shall indicate information such as the total amount of recalled products, all of the recalled products’ channels and sales information/records, etc. Said plan shall be reported to the local government.
As to violators of the draft Regulations, DOH will impose a fine between NTD$30,000 and NTD$150,000 on such enterprises. For those serious offenses, the DOH may order such enterprises to cease their business operations and revoke their factory licenses.
