Gender Equality in Employment Act Amended
Taiwan’s Legislative Yuan recently proposed an amendment to the Gender Equality in Employment Act. According to the amendment, employers will not be permitted to refuse to accept a female employee returning from maternity leave to her job for the reason that no appropriate position exists for her. Some employers have used this tact as a way of deterring female employees from taking maternity leave.
Additionally, per the amendment, the maximum fine that may be imposed on employers for successful claims of sexual discrimination is increased from NT$ 100,000 to NT$ 500,000 (Approximately US$ 3,333 to US$ 16,666).
In related news, the relevant authorities are considering the possibility of creating and announcing a blacklist of enterprises. Any enterprises that is deemed unfriendly and which has been punished for sexual discrimination of employees will be listed and the list will be made public.
