Employers will be Punished for Requesting Irrelevant Private Information
The Legislative Yuan has added some new provisions to the Employment Services Act on 13 November 2012, including a stipulation prohibiting employers from requiring employees or job applicants to offer private information that is irrelevant to the job responsibilities. Employers who violate this prohibition will be punished by a fine in the amount of NT$ 60,000 – NT$ 300,000 (approximately US$ 2,000 - US$ 10,000).
In order to protect the right to work and personal privacy of job applicants and employees, legislators amend the law in order to ban employers from requiring employees or job applicants to offer private information that is not relevant to the position or job responsibilities.The amendment states that, “when recruiting or hiring employee(s), employer shall not engage in any of the following acts: “require any job applicant or employee to provide private information that is not relevant to the responsibilities of the particular job”.
