Proposed Amendment to Act of Gender Equality in Employment
The Ministry of Labor recently indicated its support of the amendments to the Gender Equality in Employment Act (“Act”) proposed by legislators. The amendments include (1) an increase in the male paternity leave from 3 days to 5 days, (2) giving women 5 days paid leave for prenatal check-ups, and (3) three additional days of menstrual leave (currently unpaid leave) will become leave with a half day’s pay.
It is estimated that approximately 310,000 people who are general employees will benefit from the amended Act. However, the cost of providing such increased benefits to general employers will increase by approximately NT$1.26 billion per year.
If the amendments pass the third reading of the Legislative Yuan, and an employer refuses an employee’s request for leave, the employer will be punished by fine in an amount from NT$ 20,000 to NT$ 300,000.
