The proposed amendment to the Regulations for Electronic Monitoring of Sex Offenders on Probation/Parole

Taiwan's Ministry of Justice has proposed amending the Regulations for Electronic Monitoring of Sex Offenders on Probation/Parole (“Regulations”). Under the current Regulations, probation/parole officers may request permission from a prosecutor to use electronic monitoring of sex offenders who are on probation/parole if such offender has no residence or domicile, or who tend to commit their crimes at night. However, the use of electronic monitoring should be limited to a duration of 3 months, unless such period is extended by a prosecutor. According to the Ministry of Justice, amendment of the current provision of the Regulations would permit the electronic monitoring device to be used during the entire period of supervision of the sex offender on probation/parole. Probation/parole officers may still request prosecutors to suspend the use of such electronic monitoring devices if there appears to be no need for the offender to wear the monitoring device. If the draft amendment pushed by the Ministry of Justice is passed, the new Regulations would most likely become effective by the end of this year (2016).
