Amendments to Act of Gender Equality in Employment

The amendments to the Act of Gender Equality in Employment (性別工作平等法) took effective on May 20, 2016. Amongst such amendments, important provisions include the following:

1. Feeding time is not limited. Employers are required to provide additional thirty-minutes feeding time if the employee works overtime for more than one hour.

2. The employer must provide a leave of absence because of public affairs to the employee who is the victim of a sexual harassment case, if the employee is notified to attend a court hearing due to such sexual harassment case. The employer will be imposed on a penalty ranging from NTD 20,000 to NTD 300,000 and the employer’s name will be published if there is any violation of this provision.

3. Employers hiring more than one hundred employees shall provide the nursing room and child care facilities or suitable child care measures. In this amendment, the main difference is the number of employees. The number of employees is reduced from two hundred and fifty to one hundred.
