Ministry of Labor Proposes Attendance Records be Confirmed by Employees
According to the Labor Standards Act, employers are required to prepare an employee attendance record, and such record shall note information in detail related to the working time of employees. However, some employers complain that after these records are checked by local labor authorities, they were fined for not paying overtime to employees, even though many employees leave late only to deal with personal affairs. Therefore, to reduce disputes, the Ministry of Labor has drafted the Rule of Attendance Records setting forth that employers and employees shall regularly confirm the attendance records (which is not compulsory) .
According to the consultant of the Taiwan Confederation of Trade Unions, attendance records involve not only issues of overtime pay, but, also issues of fatigue and labor injury compensation. The consultant suggests that confirmation by the employees be made without influence of the employers.
