DNA Testing After Convictions Affirmed

Draft regulations that will allow defendants in criminal cases to request DNA testing have been passed by the Legislative Yuan on 1 November 2016. The regulations were draft by Wellington L. Koo and others when Koo served as a legislator.

In one high-profile case, Chen Lung-chi was convicted of sexual assault, but, was found not guilty after DNA testing overturned his conviction. There have been numerous similar cases in the U.S.

According to the regulations, after a conviction is affirmed, criminal defendants and their relatives will have the right to request DNA testing. Such testing is expected to help avoid wrongful convictions and might be used to launch retrials.
