Key Measures of the Act for the Recruitment and Employment of Foreign Talents
The Act for the Recruitment and Employment of Foreign Talents was passed into law on October 31, 2017, and went into effect on February 8, 2018. The Act aims to ease the regulations pertaining to work permits, visas, residency, taxes, and pensions for foreign talents and their parents, spouses, and children, in the hope of establishing a comfortable and convenient work and living environment for foreign nationals.
The Act distinguishes between three categories of foreign talents, namely “foreign talents,” “foreign special talents,” and “foreign senior talents”, with each category receiving distinct benefits under separate provisions.
The four key measures of the Act are as follow:
1. Foreign special talents are able to apply for an “Employment Gold Card”, which makes it more convenient for foreign nationals to transfer work or seek jobs. Also, foreign special talents will be exempt from taxation on half of any salary income in excess of NTD 3 million for the first three years of their employment.
2. Foreign talents seeking employment in Taiwan are eligible to apply for employment-seeking visas without the need to apply for the same through employers.
3. Foreign talents who work as freelance artists are allowed to obtain work permits without the need to apply for the same through employers.
4. Cram schools in Taiwan are permitted to hire foreign teachers who possess specialized knowledge or skill related to teaching. Previously, such teaching was limited to the subject of foreign languages. In addition, the Ministry of Economic Affairs has opened a period for public consultation to assist and inform the drafting of regulations governing foreign teachers with specialized knowledge or skills for the digital content industry under Item 2, Subparagraph 4, Paragraph 1, Article 4 of said Act.
