Recent Developments re Tax Issue for Bitcoin Transactions
Taiwan's Central Bank has determined that the Bitcoin is not one type of coin or currency in Taiwan, but instead is a virtual investment product with risk. The Bureau of tax has thus expressed its opinion that Bitcoin transactions are of the same nature as transactions of online game items, treasure, and game currency. If a business handles a Bitcoin transaction and the transaction amount is over 80 thousand NT Dollars, the business must register as a profit-seeking enterprise and pay the appropriate income tax.
The Ministry of Finance (MOF) also stated that a tax on Bitcoin transactions will be imposed. Also, if a person makes the transaction via any platform, a tax will also be levied on the platform operator for the handling fee obtained.
In additional, MOF indicated that if the amount of a Bitcoin transaction does not exceed the tax threshold, the Bitcoin transaction will possibly be regarded as "income of incidental trading activities" and must be voluntarily reported to the tax authority. MOF expressed further that because it is difficult to trace Bitcoin transactions due to the nature of Bitcoin, there are currently no cases where taxes have been imposed on Bitcoin transactions. MOF is currently conducting cross-department discussions with the Central Bank and the Ministry of Justice regarding the administration of Bitcoin transaction.
