Judicial Yuan Proposes Expansion of Grand Chamber's Scope of Review of Administrative Cases
Currently, general questions of law in cases adjudicated only at the third instance of trial may be reviewed by the Grand Chamber (大法庭), a special tribunal composed of nine Supreme Court judges, whose purpose is to unify opinions of law from the lower courts.
Taiwan's Judicial Yuan has announced proposed amendments to the Administrative Litigation Act, which if ratified, will expand the scope of review that the Grand Chamber may undertake, by including administrative cases adjudicated at the second instance of trial. The goal of these proposed amendments is to further resolve the recurring problem of courts at different levels issuing conflicting rulings.
