Expediting Reconstruction of Urban Unsafe and Old Buildings Amendment Passed
On November 21, 2023, Taiwan's Legislative Yuan passed an amendment to Statute for Expediting Reconstruction of Urban Unsafe and Old Buildings (都市危險及老舊建築物加速重建條例) which aims to improve the efficiency of urban renewal and residential safety.
Traditionally, a housing reconstruction project that involves both public and private property will require unanimous consent from all property owners. However, changes to the use of public property shall fall under either the Land Act, the National Property Act, the Budget Act, or other public property management regulations. As a result, such projects could face prolonged timelines due to the necessary process.
To address the issue above, the amendment stipulates that all public land and buildings shall be included in urban reconstruction, except for three cases:
1. There is another plan for the reasonable use of the public land and buildings.
2. The ratio of the area of public land reaches more than 50% of the reconstruction area.
3. The ratio of the public land area reaches more than 30% of the reconstruction area and the scope of the reconstruction plan is in line with government standards.
According to the amendment, the public land and buildings considered to be included in urban reconstruction will exclude the application of the Land Act, the National Property Act, the Budget Act or other public property management regulations.
By passing the amendment, the government believes that the amendment will boost the efficiency of public property participation in reconstruction and ensure the safety of citizens' residences.
