Amendment to Pension of Police Personnel

The Taiwanese Legislative Yuan has recently passed a revision to Police Personnel Management Act. Pursuant to the amended Article 35 of this act, police personnel are granted a higher rate of retirement income replacement.
 
Retirement benefits are calculated based on police officers’ seniority, with those serving longer entitled to higher rates of pension. According to the amendment, police officers who have served for 37 years are awarded a maximum of 80 percent of retirement income replacement. Moreover, the increase in retirement income replacement ratio also extends to already retired police officers.
 
However, Members of Parliament from the Democratic Progressive Party (DPP) have expressed serious concerns, arguing that such an increased retirement income replacement ratio would violate the principle of equality enshrined in Taiwanese Constitution, which also covers pension schemes of public service. In response, the Executive Yuan stated that it would seek any constitutional remedies against the Legislative Yuan that failed to consult with the former or clarify the funding sources for the increased pension benefits prior to passing the amendment in dispute.
