Court Rules that Advertisement Emails Violate Personal Data Protection Act

A former member of a wholesale and supply store brought a claim in litigation asserting that the store continued to utilize his personal data after he requested the deletion of the same after he provided the information as part of his application for store membership. The store also promised in a return email that said former member would no longer receive any catalogues or discount information. However, said former member continued to receive advertisement emails sent by the store.

In this dispute, the store argued that the advertisement emails sent by them are standard promotional emails, which only constitute a small portion of spam and should not have caused the plaintiff any trouble.

The judge ruled that although said former member plaintiff repeatedly asked the store to delete his personal data, the store, a famous company, continued utilizing his personal data to send advertisement emails, and that action violated the Personal Data Protection Act. Therefore, the judge ruled that the store must indemnify said former member.
