Hiring Rules and Experience Requirements Relaxed for Foreign Professionals Working in Taiwan
On September 1, 2006, the Council of Labor Affairs put into force an administrative order that lessens the experience levels required of foreigners coming to Taiwan for specialized or technical work under Article 46, Paragraph 1, Item 1 of the Employment Services Act. Now foreigners will be able to avoid the two years work experience requirement, provided they meet one of the following conditions:
1. The Foreigner is invited by a company with Ministry of Economic Affairs certification as a company whose operations headquarters, domestic or foreign enterprises have received approval for establishing an R&D center or project in Taiwan, or a technical service company that comes under one of the 10 items listed in Table 9 attached to Article 5, Paragraph 1 of the Regulations for Encouraging Manufacturing Enterprises and Technical Service Enterprises in Newly-Emerging, Important and Strategic Industries;
2. The Foreigner is recruited by science park enterprises for work in design needed for products or services, the enhancement of industrial technology or research and development, management and related research, promotion in special language areas overseas, or market surveying and analysis, etc.
On Oct. 3, 2006 the Council of Labor Affairs put into force a revision of the “Regulations on the Permission and Administration of the Employment of Foreign Workers”, further relaxing the requirements for foreign professionals taking up employment in Taiwan. The main points of the revision are as follows:
1. The following types of overseas Chinese or foreigner workers do not need to attach a copy of their graduation certification when applying to work in Taiwan: sports coaches and sportsmen, and religious, art, performance workers an any other workers approved by the competent government agency for the relevant investment or company establishment;
2. The rule for submitting applications for the extension of the employment period of foreign professionals has been extended from 60 days prior to four months prior to the expiration of the original employment period. This will provide more time for foreign employees to make arrangements for their continued residence in Taiwan.
