Supreme Administrative Court Confirmed Sanctions on HealthBanks for False Representations
HealthBanks Biotech Company Limited (HealthBanks) was reported to the Fair Trade Commission (FTC) and accused of false representation with respect to its slogans, No. 1 in Taiwan Market Share and Over 50% of Parents Choose HealthBanks. The FTC imposed administrative penalties on HealthBanks.
Although HealthBanks filed an administrative appeal, the Supreme Administrative Court held that HealthBanks’ defense using sales amounts was unable to accurately calculate its share of the market. Moreover, according to documentary evidence submitted, sales amounts of competitors in 2004 were higher than HealthBanks’ sales. Based on these statistics and facts, the Supreme Administrative Court upheld the FTC’s administrative sanctions.
