New Regulations to Control Chinese Investment in Taiwan Real Estate

Taiwan's Ministry of the Interior recently announced the latest amendments of "Regularions for Permissions for the People of the Mainland Area to Obtain, Register, or Transfer Real Estate". Whereas these Regulations stipulate whether people from China may obtain rights in and to Taiwan real estate, the latest amendments narrow the scope of such permissions.

Pursuant to the latest amendments of the aforesaid Regulations, Chinese people may only obtain Ownership or Surface Rights in and to one house per person. Also, the purpose of such houses is limited to residential use and leasing of such houses is forbidden.

After obtaining permission to purchase residential real estate in Taiwan, should the applicant not purchase or register any real estate within one (1) year, such permission shall be revoked.

Moreover, in the event of any violation of the aforesaid Regulations occurs after such permission is issued, the Authority may compel the owner of such real estate to sell it within one (1) year, or have such real estate sold should the owner refuse or otherwise fail to do so.
