On June 25, 2024, Legislator Luo, Chi-Chiang (羅智強) and 16 other legislators proposed a bill to amend Taiwan’s Condominium Administration Act Building Administration Division (公寓大廈管理條例). The bill responds to an increasing number of incidents where ceramic building tiles fall off the exterior walls of older buildings due to extreme temperature changes caused by climate change.
The draft amendments seek to mitigate public safety risks associated with these incidents. Key provisions of the draft include:
- Local Government Subsidies: The Central Government would be authorized to subsidize local government exterior wall inspections and repair programs.
- Central Government Incentives: The Central government should develop incentive that take into account local government finances and levels of public risk levels (such as strata, building age, population density, etc.) to encourage local governments to prioritize maintenance and subsidies.
- Emergency Measures: The bill would grant the competent authority (regulator) the power to take immediate action including direct legal action against owners, managers, or building committees to seek interim relief and subsequent compensation when a building poses a major or imminent danger.
Legislator Luo highlighted the success of Taipei City Government's subsidy initiatives, which were initiated in 2019. According to Luo, these initiatives significantly reduce the number of tile-fall incidents from 881 cases in 2019 to approximately a total of 200 cases in 2022 and 2023 combined—a reduction of nearly 80%. The draft amendment aims to build on this success nationally with the proposed subsidies, incentives, and emergency measures.
